DePuy Hip Recall
DePuy, a division of Johnson & Johnson, announced on Aug. 26, 2010, a nationwide DePuy hip recall of two ASR hip replacement systems it manufactures, the DePuy ASR XL Acetabular Hip System and the ASR Hip Resurfacing System. These artificial hips and joint replacement models contain design flaws stemming from too-shallow cups that do not properly house the ball associated with the joint replacements. This latest medical product recall for Johnson & Johnson affects all 93,000 devices that have been implanted since they became available for use in July 2003.
As a result of this design flaw, the metal parts have been known to scrape against one another. This is causing a wide variety of complications, and the device is failing much earlier than the 20 years it is supposed to last. Doctors must remove and replace the device, and the use of these specific models has been discontinued.
As part of the DePuy hip recall, Johnson & Johnson has announced that it intends to cover the reasonable and customary costs of monitoring and treatment related to defective hip replacements. However, this is misleading because it requires an extensive claims process in which you also must provide access to your medical records and proof of the failed hip, which would otherwise be used as evidence in a hip replacement lawsuit against the company. Then, if all of these conditions are met, DePuy or Johnson & Johnson will pay only out-of-pocket expenses that are not covered by your insurance.
